DMCA

This Digital Millennium Copyright Act (“DMCA”) Policy explains how TheGulfCareer.org (“we”, “our”, “us”) addresses claims of copyright infringement on the Website. This policy is designed to satisfy 17 U.S.C. §512 (DMCA). We also consider good-faith takedown requests from outside the United States where appropriate.

Our Role

TheGulfCareer.org is a job information platform. We do not host or distribute employer-owned application materials or third-party files beyond the content displayed on our pages. If you believe material on our Website infringes your copyright, please submit a written notice as described below.

Designated Copyright Agent

Please send DMCA notices and counter-notices to our designated agent:

Email: contact@thegulfcareer.org
Web: https://thegulfcareer.org/contact-us/

Use a clear subject line such as “DMCA Notice” or “DMCA Counter-Notice”. Email is preferred for fastest handling.

How to File a DMCA Notice (Takedown Request)

If you are a copyright owner or authorized agent, send a written notice containing all items required by 17 U.S.C. §512(c)(3):

  1. Signature: A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the work: Identify the copyrighted work you claim is infringed (or a representative list if multiple works).
  3. Identification of the material: Identify the material you claim is infringing or the subject of infringing activity, including the precise URL(s) on our Website and enough information to locate the material.
  4. Contact information: Your full name, company (if applicable), mailing address, telephone number, and email address.
  5. Good-faith statement: A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

What Happens After You Send a Notice

  • Acknowledgment: We review the notice for completeness. Incomplete notices may be rejected or delayed pending clarification.
  • Content action: If the notice appears valid, we may remove or disable access to the identified material.
  • Notice to user: We will notify the user or content source responsible for the material and may share your notice, including contact details, so they can respond.

How to File a Counter-Notification

If your content was removed due to a DMCA notice and you believe the removal was a mistake or misidentification, you may file a counter-notification pursuant to 17 U.S.C. §512(g)(3). Your written counter-notification must include:

  1. Signature: Your physical or electronic signature.
  2. Identification: Identification of the material that was removed or to which access was disabled, and the location (URL) where the material appeared before it was removed.
  3. Good-faith statement: A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction: Your name, address, and phone number, and a statement that you consent to the jurisdiction of the competent courts where you are located, and will accept service of process from the person who provided the original DMCA notice or their agent. (If you are in the United States, consent to the Federal District Court for your address.)

Send the counter-notification to our designated agent by email. We will forward it to the original complainant.

Restoration of Content

If we receive a valid counter-notification, we may restore the removed material after no fewer than ten (10) and no more than fourteen (14) business days, unless our agent first receives notice that the complainant has filed an action seeking a court order to restrain you from engaging in infringing activity related to the material.

Repeat Infringer Policy

It is our policy, in appropriate circumstances and at our discretion, to disable or terminate access for users who are determined to be repeat infringers. We also reserve the right to remove content alleged to infringe without prior notice and to remove accounts involved in egregious violations.

Notifications Outside the United States

We respect intellectual property rights globally. If your claim arises under non-U.S. law, provide equivalent information establishing your rights and the alleged infringement. We may request additional documentation to substantiate ownership and jurisdiction.

Misuse and Bad-Faith Notices

Submitting false claims or misrepresenting infringement may expose you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. §512(f) or analogous laws. Please ensure you have a good-faith basis and the authority to file the notice.

Other IP Complaints (Trademark, Privacy, etc.)

For non-copyright matters such as trademark misuse, privacy, or defamation, contact us with clear documentation and links. We will review under our policies and applicable law, which may require different procedures than the DMCA.

Privacy of Notices

We share complete DMCA notices and counter-notices, including contact information, with the affected party and, if necessary, with service providers, hosting companies, or law enforcement. We retain records as needed for compliance and to administer our policy.
